This Service Agreement is made between Duckett Plumbing and the customer for the provision of plumbing services. By engaging our services, the Customer agrees to the following terms and conditions:
Scope of Services:
Provider agrees to perform the plumbing services as agreed upon and specified in the work order or proposal, which may include but is not limited to installations, repairs, maintenance, and inspections.
Service Charges and Payment:
Customer agrees to pay the agreed-upon service charges as outlined in the work order or proposal. Payment is due upon completion of the services rendered, unless otherwise specified in writing. Any additional costs incurred during the provision of services, such as materials or unforeseen repairs, will be communicated to the Customer for approval prior to proceeding.
Appointment Scheduling and Cancellations:
Provider will work with the Customer to schedule appointments at mutually agreed-upon dates and times. In the event that the Customer needs to cancel or reschedule an appointment, a minimum notice of [number of hours/days] is required. Failure to provide sufficient notice may result in a cancellation fee.
Warranty:
Provider warrants that the services performed shall be done with reasonable skill, care, and in accordance with industry standards. In the event of any defects or issues arising from the services rendered, Provider will, at their discretion, either rectify the problem or provide a refund or credit for the affected services.
Limitation of Liability:
Provider shall not be liable for any damages, losses, or expenses arising from the provision of services, except for damages directly caused by Provider’s negligence or willful misconduct. Provider shall not be responsible for any pre-existing conditions or damages related to the plumbing system unless otherwise specified in writing.
Indemnification:
Customer agrees to indemnify and hold Provider harmless against any claims, liabilities, damages, or expenses arising out of the services provided, except to the extent caused by Provider’s negligence or breach of this Agreement.
Confidentiality:
Provider agrees to keep all customer information and any proprietary or confidential information disclosed during the provision of services strictly confidential.
Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of South Carolina. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in South Carolina.
Entire Agreement:
This Agreement constitutes the entire understanding between the Provider and the Customer and supersedes any prior agreements or understandings, whether written or verbal, relating to the subject matter herein.
